Unhappy Trying to do the right thing.

I got hired on by a home owner to install a new gas line to her stove. I arrived at the job site after the stove was pulled out of recess by the home owner and electrician. Apparently the stove was not secured and was very unstable. I bumped the stove a little and it tipped over damaging the cabinetry and dishwasher. The home owner and electrician left it in the middle of the kitchen with little room to get by to perform my duties. I notified the home owner of the damage and I showed her how unstable the stove was, at that point we decided I would complete the project and we would decide what to do about it afterwords. My point of view is that the electrician and home owner should have secured the stove they had knowledge it was unstable and were the one who pulled it, and didn't mention it to me. It and it was kind of a booby trap, on the other hand it was my action that caused it to tip over. In the end I bit the bullet and ended up giving her $300.00 for damages to avoid any negative p.r. I just wonder what different views anyone has about this situation.

If there was no reasonable way for you to know that is was going to fall, then she should eat it.

for the most part the first time i touched stove was when i pumped it. Afterwords i was able to demonstrate to the customer how unstable the stove was by knocking it over with one finger

they should of made the way clear for you, sounds like they had a lack of due diligence in the situation

Those stoves are supposed to have anti-tip brackets installed into the floor.

Of course, with your moving the unit that would unhook it from the bracket.



Would have to see how it happened but I would say that you're on the hook.....well not anymore since you paid out of pocket.

that is too bad, but I have been stuck with much worse just because one of my guys was the last fellow
at the property....and that was to the tune of 15k.....

just cross your fingers and hope that they dont try to shake you down for more money

One of the many reasons why we carry insurance. Some sort of mishap on the job, I call my agent, and let him handle the problem. So far in the 50 years we been around there has only been 1 claim.

Was a rodding from a roof. Home owner knew it and set up his ladder for the guys to use. Our plumber had his own ladder but the guy insisted we used his. As the plumber went up the ladder, it started to give way and fall. The plumber broke his hand and the ladder ripped up the vinyl siding. Of course the guy wanted us to replace all the siding since a repair would not match the sun bleached siding. We called our agent, which he in turn contacted the home owners insurance company and explained to them that the home owner insisted we used his ladder which injured our worker. The home owners insurance agreed with our agent that we are just liable to make the repair to the siding for two reasons, if the home owner let us use our ladder the accident may not have happened, but the real deciding factor was the siding was over 25 years old.

If you paid the piper and left customer happy, perhaps you can make some of this money back in the future. Its a hard pill to swallow. Also I obviously have liability insurance, but I don't and never have used it unless it is major catastrophe. Claims con kill you.

My thoughts on the situation was that it is the responsibility of who ever moved the oven out of recess. They had knowledge the the tip bar was removed and the unit was not secure. I did not have any idea that the unit was unstable until it fell over. I actually caught the unit before it hit the cabinetry and dishwasher but the position i was in and the weight of the unit was too much for me to stop. Anyways feeling this way i also felt that if it became a issue i might not come out OK if it went to mediation and besides i bride myself with being people friendly and prefer to ovoid any negative that came from this incident. To me i'd rather loose money than have a angry customer. I gave her a hundred dollars more than she wanted because of the expression on her face and afterwords i had her sign the invoice noting that she received money to settle damages caused by improperly secured oven. Next question is should i report incident to my insurance/bond company when a incident happens. Thanks for feed back guy. i really appreciate your opinions.
